Terms of Service

These Terms of Service (the “Terms”) are a binding agreement between you and Sendero Maps ("Sendero Maps", "we", "us", or "our") and govern your use of the Sendero Maps mobile application (the “App”) and the senderomapping.com website (together, the “Services”). By downloading, accessing, or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
1. Eligibility
You must be at least 13 years old to use the Services. If you are under 18, you may use the Services only with the involvement and consent of a parent or legal guardian, who agrees to these Terms on your behalf. Any purchase must be made by someone able to enter a binding contract.
2. The Services
Sendero Maps provides trail discovery, maps and navigation (including augmented-reality navigation), trail knowledge and audio, optional AI features, social and progress features, and optional safety features. We may add, change, suspend, or discontinue any part of the Services at any time. We are not obligated to store or maintain your content indefinitely.
3. Your account
- You must provide accurate information and keep it current.
- You are responsible for safeguarding your login credentials and for all activity under your account.
- Accounts are for a single person; do not share, sell, or transfer your account.
- Notify us promptly of any unauthorized use or security breach.
- You may delete your account at any time from within the App.
4. Subscriptions, billing, and cancellation
Some features require a paid subscription (“Cumbre”). Cumbre is sold as an auto-renewing subscription through the Apple App Store, and your purchase is also subject to Apple’s terms.
- Billing. Payment is charged to your Apple ID account at confirmation of purchase.
- Auto-renewal. Your subscription automatically renews for the same period unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
- Managing & canceling. You manage and cancel your subscription in your Apple App Store account settings, not through us. Deleting the App does not cancel a subscription.
- Refunds. Purchases are handled by Apple, and refunds are subject to Apple’s policies and applicable law. We generally cannot issue refunds for App Store purchases.
- Changes. We may change subscription prices, features, or the features available on the free tier. Where required, we will give notice; price changes apply to future billing periods.
5. AI features
Features such as “Scout,” “Ask the Trail,” and trip planning generate responses using a third-party AI provider. AI output may be inaccurate, incomplete, or outdated and is provided for general information only. It is not professional, medical, safety, legal, or navigational advice, and you should not rely on it for any decision affecting your safety.
6. Safety, outdoor risk, and no reliance
Outdoor activities are inherently risky and can result in serious injury or death. By using the Services you acknowledge and agree that:
- You assume all risks of hiking and outdoor recreation, and you are solely responsible for your own safety, preparation, physical condition, and decisions.
- The Services are an aid only — not a substitute for proper planning, skills and experience, official maps, current conditions, ranger and local guidance, appropriate gear, and your own judgment.
- Maps, trails, points of interest, elevation, difficulty, distance, and location data may be inaccurate, incomplete, or out of date, and GPS may be unavailable or wrong. Do not rely on the Services as your sole means of navigation.
- The Send-my-Route safety features (live location links and overdue-return alerts) are not an emergency, monitoring, or rescue service. They depend on your device’s battery and connectivity, third-party networks and providers, and your trusted contacts, and may be delayed, incomplete, or fail entirely. Do not rely on them as your only safety measure — carry appropriate equipment (for example a map and compass and/or a satellite messenger or personal locator beacon) and leave a plan with someone you trust.
- In an emergency, contact local emergency services directly (911 in the United States). The Services do not contact emergency services for you.
- You are responsible for complying with all trail closures, permits, private-property boundaries, and local laws and regulations.
7. Acceptable use
You agree not to:
- Use the Services for any unlawful purpose or in violation of these Terms;
- Copy, scrape, harvest, reverse engineer, decompile, or attempt to extract the source code, trail data, or knowledge content of the Services, except as permitted by law;
- Circumvent, disable, or interfere with security, access controls, paywalls, or usage limits;
- Access the Services through automated means, or disrupt or overload our systems or providers;
- Upload or share content that is unlawful, infringing, harmful, harassing, deceptive, or that you do not have the right to share;
- Impersonate anyone, or misrepresent your affiliation.
8. Your content
You retain ownership of content you submit (such as reviews, ratings, and photos, “User Content”). You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute your User Content in connection with operating and promoting the Services. You represent that you have the rights to your User Content and that it does not violate any law or third-party right. We may remove User Content at our discretion. If you send us feedback or suggestions, you grant us the right to use them without obligation to you.
Community standards — zero tolerance. There is no tolerance for objectionable content or abusive users. Do not post content that is hateful, harassing, threatening, sexually explicit, violent, or otherwise objectionable, and do not target other users. You can report any review, photo, or profile, and block any user, from within the App. We review reports within 24 hours, and we remove content that violates these Terms and suspend or terminate the accounts of users who post it.
9. Intellectual property
The Services and their content, features, software, and trademarks are owned by us or our licensors and are protected by intellectual-property laws. Subject to these Terms, we grant you a limited, personal, non-transferable, revocable license to use the Services for their intended purpose. Map and trail data are provided by third parties (including OpenStreetMap contributors and Mapbox) and are subject to their respective licenses. All rights not expressly granted are reserved.
10. Third-party services
The Services rely on and link to third parties (including Apple, Google, Mapbox, and others). We do not control and are not responsible for third-party services, their content, or their practices, and your use of them may be subject to their own terms.
11. Disclaimers
To the fullest extent permitted by law, the Services are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranties regarding accuracy, reliability, or availability. We do not warrant that the Services will be uninterrupted, error-free, or secure, or that any trail, map, location, or safety feature will be accurate or function as intended.
12. Limitation of liability
To the fullest extent permitted by law, Sendero Maps ("Sendero Maps", "we", "us", or "our") and its officers, contractors, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or for any personal injury, death, or property damage, arising out of or relating to your use of (or inability to use) the Services or your outdoor activities, even if advised of the possibility of such damages. To the fullest extent permitted by law, our total liability for any claim relating to the Services will not exceed the greater of the amount you paid us for the Services in the twelve months before the claim, or US $100. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
13. Indemnification
You agree to indemnify and hold harmless Sendero Maps ("Sendero Maps", "we", "us", or "our") from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Services, your User Content, your violation of these Terms, or your violation of any law or third-party right.
14. Termination
We may suspend or terminate your access to the Services at any time, with or without notice, if we believe you have violated these Terms or to protect the Services or other users. You may stop using the Services and delete your account at any time. Sections that by their nature should survive termination (including Sections 6, 8–13, and 15–17) will survive.
15. Apple App Store — additional terms
These terms apply if you obtained the App through the Apple App Store:
- These Terms are between you and Sendero Maps ("Sendero Maps", "we", "us", or "our") only, not Apple, and Apple is not responsible for the App or its content.
- Apple has no obligation to provide any maintenance or support for the App.
- In the event the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
- Apple is not responsible for addressing any claims relating to the App, including product-liability, legal or regulatory compliance, consumer-protection, or intellectual-property claims.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated as “terrorist supporting,” and that you are not on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
16. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the Services after an update means you accept the revised Terms.
17. Governing law and disputes
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. You agree that any dispute not otherwise resolved will be subject to the exclusive jurisdiction of the state and federal courts located in Texas, and you consent to venue there.
